China court grants Qualcomm injunction against Apple, bans sales of some iPhones

Qualcomm's claim of having a resolution on the doorstep is far from reality after a court in China granted the chipmaker an injunction against Apple. 

CNBC reports that the Fuzhou Intermediate People's Court in China granted two preliminary injunctions against four Apple subsidiaries in the country. This is likely based on the lawsuit filed by Qualcomm in October 2017 claiming that Apple had used its technologies without paying for them. 

Qualcomm issued a statement to CNBC stating that the injunctions will ban the import and sales of nearly all iPhone models in China.

Qualcomm - "We deeply value our relationships with customers, rarely resorting to the courts for assistance, but we also have an abiding belief in the need to protect intellectual property rights."

However, Apple is disputing the scope of the ban and said that it only applies to iPhones running on iOS 11. The iPhones sold today ship with iOS 12, which do not violate the patents in question. 

"Qualcomm's effort to ban our products is another desperate move by a company whose illegal practices are under investigation by regulators around the world," Apple said in a statement. "All iPhone models remain available for our customers in China. Qualcomm is asserting three patents they had never raised before, including one which has already been invalidated. We will pursue all our legal options through the courts."

Nonetheless, news of the injunction caused Apple shares to fall 2% while shares of Qualcomm went up 3%. Apple's stock has been hit badly recently by numerous reports that its 2018 iPhone lineup is not doing as well as it has expected.
