Samsung Looks to Preemptively Ban Next iPhone in Korea

The legal tussle between Apple and Samsung is heating up. And it's Samsung's turn to strike. The Korean CE giant will move to have Apple's next iPhone iteration banned from sale in Korea, following injunctions served against Samsung's smartphones and tablets in many European countries, including ongoing proceedings in France, Italy, UK, US, Japan, and Korea.

According to a senior executive from Samsung Electronics who spoke to The Korean Times, Samsung plans to take Apple to court in Korea after its presumed iPhone 5 launch, mainly for Apple's violation of Samsung's wireless technology related patents. "For as long as Apple does not drop mobile telecommunications functions, it would be impossible for it to sell its i-branded products without using our patents. We will stick to a strong stance against Apple during the lingering legal fights," he said.

To date, Apple has won an injunction against the Galaxy Tab 10.1 in Germany. Samsung also had to pull its Galaxy Tab 7.7 device from the IFA conference in Berlin after Apple moved to have the 7.7-inch tablet covered under a similar injunction. Samsung's smartphones weren't spared as well. Apple also won an EU-wide injunction against the Galaxy S, Galaxy SII and Ace handsets in the Netherlands. Samsung's release of the Galaxy Tab 10.1 in Australia is still on hold since legal proceedings are in progress. 

Apple's proposed preliminary injunction against Samsung is set for hearing on October 13 in the US. At the final count, Apple's latest legal salvo includes an injunction filed against Samsung's smartphones and tablets in Japan.
