Polaroid sues GoPro over the design of its Hero4 Session camera

Besides having to deal with slowing sales of its cameras, GoPro now has a patent lawsuit to handle. 

C&A Marketing Inc., the exclusive maker of Polaroid-branded cameras, has filed a patent lawsuit against GoPro over the design of the Hero4 Session. C&A Marketing Inc alleges that GoPro copied its design of the Polaroid Cube camera which is covered by a patent received in May.

GoPro reportedly told the Wall Street Journal that it received several E.U patents and one U.S patent for the Hero4 Session in March. Moreover, the patents' applications indicated that GoPro was working on the Hero4 Session before the Polaroid maker filed for the design patent.

The outcome of the lawsuit might depend on the 12-word claim of C&Marketing's design patent which reads: “The ornamental design for a cubic action camera, as shown and described” with seven images of the Polaroid Cube. If GoPro is found guilty, it has to halt sales of the Hero4 Session and pay a certain amount of money to C&A Marketing Inc. as compensation.

GoPro unveiled the Hero4 Session in July which is its smallest and lightest camera yet. Two months later, the company slashed its price by S$140 when it announced the entry-level Hero+ camera.
