The battle to control the new consumer electronics market is turning nasty, with Apple suing Amazon over the utilization of the term "App Store". Although the term has now become common parlance, other services such as the Google's Android Market stayed far away from using it since it is an Apple trademark allowing them to seek damages for any infringement. Amazon began using the "App Store" moniker early this year and had recently upped the frequency of its usage in promotional materials for its exclusive launch of Angry Birds Rio for android.
bloomberg.com - Apple Inc. (AAPL) sued Amazon.com Inc., saying the online retailer is using Apple’s “App Store” trademark to sell software applications for mobile devices. Apple, in a March 18 complaint in federal court in northern California, accused Amazon.com of trademark infringement and unfair competition. The company asked for a judge’s order to prevent the company from using the “App Store” name and for unspecified damages.
